A US restriction that previously blocked only new foreign drone models could reach products already sitting on store shelves. The Federal Communications Commission is considering import and marketing prohibitions for certain previously authorized foreign-made drones with LiDAR, thermal imaging, docking systems, swarming functions, and other features it groups under a “military-grade” definition. If the proposal is adopted as written, new imports and sales could stop roughly 180 days after publication.
The stakes extend well beyond specialized defense aircraft because LiDAR is a common safety and mapping sensor. It measures distance with laser pulses and helps consumer drones avoid obstacles or build precise three-dimensional maps. Tom’s Hardware reported on August 9, 2026 that popular products such as DJI’s Air 3S and Mini 5 Pro could disappear from US retail channels because they use LiDAR for obstacle detection. Existing owners would not be barred from flying their aircraft, though official replacement parts and substitute units could become harder to obtain.
The FCC notice in the Federal Register lists the proposed categories. They include aircraft weighing 55 pounds or more at takeoff; drones able to dispense agricultural chemicals; models carrying LiDAR or thermal sensors; aircraft using docking stations; systems integrating a defense article; and drones capable of coordinated swarming. The swarming language is broad enough that synchronized drone light-show systems may also fall within the review.
The proposal applies to foreign-produced aircraft and critical components on the FCC Covered List. US-made drones and products outside that list are not directly affected even when they contain the same sensors. In December 2025, the FCC added all foreign-produced drones and critical components to the list, preventing new models from receiving the equipment authorization required for US sales. Products authorized before that decision could remain on the market. This proceeding targets that remaining route.
DJI argues that treating LiDAR as a military feature mistakes a civilian safety tool for a weapon. Thermal cameras and accurate distance sensing support firefighting, search and rescue, surveying, agriculture, and infrastructure inspection. The FCC’s case rests on an executive-branch national-security determination that foreign-produced drones pose an unacceptable risk to US national security and to the safety of people in the country.
No final prohibition is in force yet. Comments in PS Docket No. 26-189 are due September 2, 2026. The central question is whether the FCC narrows the boundary between ordinary safety sensors and military capability before issuing a decision. Its answer could reshape not only consumer drone availability but also parts supply and procurement for surveyors, farms, emergency services, and industrial inspectors.
